Fair Housing and Public Accommodation Laws 

Baird Holm represents property managers, developers, builders, design professionals and nonprofit organizations in all aspects of fair housing and public accommodation law. Our clients must comply with a myriad of federal anti-discrimination laws (Fair Housing Act, Americans with Disabilities Act, Rehabilitation Act, Title II of the Civil Rights Act) as well as state and local laws. Property managers face fair housing questions in screening applicants, enforcing housing rules and addressing reasonable accommodation requests. Builders and design professionals must ensure they comply with the various accessibility requirements imposed by these laws. We draft policies and provide advice to assist our clients in complying with all fair housing and public accommodation laws, keeping in mind the practical ramifications for the operation of their businesses. We also advise our clients on the additional regulatory hurdles they face when receiving federal funding from the U.S. Department of Housing and Urban Development, the U.S. Department of Agriculture and other federal and state agencies.

Public accommodation is a distinct area of the law that the firm is well equipped to address. The firm's commercial clients face similar issues to housing providers, such as meeting design and construction standards and implementing policies affecting their customers.

Fair Housing and Public Accommodation Litigation

The firm represents clients in numerous federal courts across the country, as well as before administrative agencies such as the U. S. Department of Housing and Urban Development. We also represent clients before state courts and administrative agencies in Nebraska, Colorado, Iowa, Kansas, Minnesota, Missouri and Wyoming.

Although we try cases, the vast majority of cases are resolved when we win summary judgment for our clients or achieve a settlement consistent with their goals. We attempt to control each case from the outset by conducting an early case analysis. We also collaborate with our clients to form a unique strategy for each case. When requested, we place our analysis and strategy in writing and provide case budgets.
