Fair Housing & Public Accommodation Law

OUR FOCUS

Baird Holm attorneys represent individuals, developers, property managers, and nonprofit organizations in all aspects of fair housing and public accommodation law. Our clients must comply with a myriad of federal anti-discrimination laws (Fair Housing Act, Americans with Disabilities Act, Rehabilitation Act, and Title II of the Civil Rights Act), as well as state and local laws. Property managers face fair housing questions when screening applicants, enforcing housing rules and addressing reasonable accommodation requests.

OUR SERVICES

  • Draft policies and provide advice to assist our clients in complying with all fair housing and public accommodation laws, keeping in mind the practical ramifications for the operation of their businesses.
  • Advise our clients on the additional regulatory hurdles they face when receiving federal funding from the U.S. Department of Housing and Urban Development, the U.S. Department of Agriculture, and other federal and state agencies.
  • Advise developers, builders, architects, and other design professionals on the various accessibility requirements imposed by federal and state laws (the differences between federal accessibility standards and state and municipal building codes have caused widespread confusion and noncompliance).
  • Assist our clients in not only understanding the accessibility requirements of the ADA, Section 504, and the Fair Housing Act, but also the interpretations of HUD and the Department of Justice of the more complicated aspects of federal accessibility laws.

FAIR HOUSING & PUBLIC ACCOMMODATION LITIGATION

OUR FOCUS

We represent clients in numerous federal courts across the country, as well as before administrative agencies such as the U. S. Department of Housing and Urban Development. We are often retained to defend targets of federal government "pattern or practice" investigations and complaints brought by the United States Department of Justice throughout the country. We also represent clients before state courts and administrative agencies in Nebraska, Colorado, Iowa, Kansas, Minnesota, Missouri, and Wyoming.

OUR SERVICES

  • Resolve a vast majority of cases when we win summary judgment for our clients or achieve a settlement consistent with their goals.
  • Control each case from the outset by conducting an early case analysis.
  • Collaborate with our clients to form a unique strategy for each case.
  • When requested, we place our analysis and strategy in writing and provide case budgets.
