EEO-1 Filing Deadline Extended

On February 1, 2019, the EEOC announced its extension of the EEO-1 filing deadline to May 31, 2019.

The EEO-1 survey must be filed annually by private employers with 100 or more employees, and by federal contractors with 50 or more employees and a federal contract/subcontract in excess of $50,000. The survey requires employers to report information regarding the race, ethnicity, and gender of its workforce by job category.

As you may recall, the EEO-1 filing deadline used to be September 30th of each year. In 2016, the EEOC announced its intent to collect “summary pay data” as part of the annual report, and moved the filing deadline to March 31st to help facilitate that new requirement. In 2017, however, the Office of Management and Budget (OMB) halted the pay disclosure requirement, but left the new deadline in place.

Fast forward to present day, where the EEOC blames a “partial lapse in appropriations” (due to the government shutdown) for postponing the filing date to May 31st. Employers and federal contractors may start to file the reports once the EEO-1 filing portal opens up in early March.
