Early Bird Session: Advanced Health Care Issue Spotting—Have You Thought of These?
There are many compliance pitfalls in the health care world. This session will feature a rapid run-through of commonly overlooked or seldom discussed issues, including the risks of hidden financial relationships with physicians (who knew Dr. X owns a Culver's franchise?), recent changes to tax-exempt bond compliance requirements, common errors in medical staff relations, and "Is the Apple Watch a Medical Device?," to name just a few.

Session I: Commonly Heard in Hospitals Across America – "Pay Me More"
Hospitals of all sizes are struggling to keep quality physicians in their communities and want to offer the best (and most compliant) compensation packages possible to keep them from looking elsewhere. However, many do so without realizing the potential land mines associated with structuring physician compensation packages and the levels of physician compensation being offered. This session will explain the sometimes unknown and often overlooked legal and compliance implications related to physician compensation packages.

Session II: Your Hospital’s Right to Remain Silent: HIPAA-Compliant Disclosures to Law Enforcement
Determining if someone in your organization can make a disclosure of protected health information to law enforcement isn’t black and white. Even though an officer with a uniform, gun, and badge might be standing at the facility demanding information, HIPAA still applies and an applicable exception must be met. This session will explore several common scenarios involving law enforcement--including mandatory reports (e.g., suspected child abuse) and permissible reports (e.g., allowing law enforcement to speak with a patient as part of an investigation, or calling law enforcement to assist with a violent patient). This session will also provide useful guidance for establishing a collaborative, working (and HIPAA compliant!) relationship with local law enforcement.

Session III: The Telemedicine/Telehealth Explosion; Keeping Up With the Legal Issues
Telemedicine is expanding more quickly than was anticipated. The growth pushed the envelope in terms of practitioner licensure and credentialing practices. While there are attempts to streamline these processes, these improvements are not moving quickly enough. There are also challenges in determining whether telemedicine practice standards for telemedicine differ from traditional practice. Who is the captain of the ship? Third party payers and providers both are trying to adapt to changing payment and reimbursement rule for telemedicine. Finally, when second opinions are sought, and third party reimbursement is not available, compliance demands that compensation for the professional services be consistent with fair market value. And as a new market, FMV for telemedicine can be uncertain.

Session IV: A New Generation of Workplace Harassment – Issues, Challenges and the Latest Requirements for Compliance
In the wake of Weinstein, Matt Lauer and numerous other headlines, the view of workplace harassment has changed. In addition, the EEOC has developed guidance which alters the model of harassment prevention, training, policies and employer actions. This session will examine the current status of workplace harassment and actions employers must take according to the latest guidance.

This session includes a fast-paced discussion of a variety of issues affecting health care organizations. This panel of Baird Holm attorneys will cover recent topics including compliance and governance issues, information privacy and security updates, employee benefits issues, and several other health care law topics.
