This session will explore the current trends of cryptocurrency trading, the trading platforms, and the international aspects of the cryptocurrency exchanges. We will also review how the platforms are being used to commit fraud as well as the investigative steps necessary to identify the ultimate recipients of the trades and transfers. Finally, we will discuss the investigative and litigation steps necessary to protect a cryptocurrency investment and the discovery process for unraveling the issues.

After several years anticipating the adoption of comprehensive data privacy regimes in our own backyard, Iowa and Nebraska have both passed legislation that take effect on January 1, 2025. This session will take a deep dive into the applicability of each law to determine whether your organization has compliance obligations and just what those compliance obligations include. We’ll conclude the session with a discussion of practical tools and mechanisms for compliance.
11:00 am – 11:45 am | Federal Data Privacy – What’s In, What’s Out and the Impact of Chevron

This past year has seen ongoing efforts to pass privacy bills at the federal level. In the health care sector in particular, there is a new Final Rule changing HIPAA for the first time in over 10 years to address concerns stemming from the overturning of Roe v. Wade. The Final Rule has far-reaching implications. But the Supreme Court’s willingness to overturn decades old precedent could have implications on federal privacy rules (and federal rules in general). This session will review the new HIPAA Rule to Support Reproductive Health Care Privacy. We will also discuss the Court’s recent decision in Loper Bright Enterprises to overturn Chevron and eliminate the deference courts must give to agency interpretations of federal law.

Adobe has recently come under scrutiny for a controversial update to its Terms of Service that allows its widespread use of data in connection with certain tools. This session will look at the particulars of those Terms and
key takeaways in connection with evaluating other click-through Terms of Service.
Part 2 Final Rule for Non-Providers

Finally! The newest Part 2 Final Rule, which outlines the requirements related to the confidentiality of substance use disorder records, was published in the Spring. This session will examine the new Final Rule, its alignment with HIPAA, and how it affects non-provider businesses who support SUD treatment providers.
New Technologies Beware!

Lawyers are fighting new technologies – such as chatbots, session replay software, and pixel tracking – with old(er) laws, such as the Electronic Communications Privacy Act and the Video Privacy Protection Act. On April 23, 2024, the Federal Trade Commission issued a final rule banning most non-competes nationwide. Barring successful judicial challenge, the rule is set to go into effect on September 4, 2024. This short presentation will outline what steps (if any) your business needs to take with regard to your current restrictive covenants, and offer best practices for protecting your organization and confidential information moving forward.
