Grab a coffee!  No need for the newspaper – we’ve got the headlines covered during this fast-paced review of the year’s significant legal and regulatory updates in the health care world.  These updates include Federal and State case law updates, proposed and final rules, agency guidance, settlements, and other news you might have missed.  John Holdenried, Michael Chase and Kristin Lindgren will present a brief overview of these noteworthy topics that impact a variety of health care organizations.  The goal of this session is not to scare you but to provide you with lessons learned and action steps to take.

As the January 1, 2023 enforcement deadline approaches, the No Surprises Act is coming into focus.  In this session, Barbara Person and Erin Busch will unpack the latest surprises in the final rules, alternative dispute resolution process, implementation challenges, common mistakes and misunderstandings, and CMS guidance and forms. Barbara and Erin will also provide an update on recent developments related to price transparency laws, enforcement, and penalties for noncompliance.  This session will help you better set your priorities for price and billing transparency compliance.

10:45 – 12:00 p.m. | Primer on Rural Hospital Issues – For Rural Hospitals and Their Partners

You’re telling me that health care in rural America is different and the same?!?  From physician-hospital compensation relationships to new and interesting federal policies directed toward rural providers, yes, health care in rural America is subject to the same rules and regulations with a number of differences.  This program will explore a broad spectrum of legal and compliance issues and opportunities for rural providers.  These issues and opportunities range from differing approaches to decoding the “fair market value” standard in physician-hospital compensation arrangements to the new “rural emergency hospital” status. Join Andy Kloeckner, Chandler Gall and guest presenter, Kevin Walker from CBIZ, to explore the health care compliance landscape in rural America.

2:00 – 3:00 p.m. | Health Care Compliance Considerations in a Post-Dobbs World
Kimberly A.  Lammers, Abigail T. Mohs, and Kristin N. Lindgren
Dobbs v. Jackson overturned Roe v. Wade and remanded decisions about abortion rights and privacy to state laws. Since then, the legal landscape has been changing on an almost daily basis. Many of the new laws affect providers who do not perform elective abortions. All providers are struggling with the impact and in some cases unintended consequences of the changing laws. Kim Lammers, Abby Mohs and Kristin Lindgren will provide an overview of current Nebraska and Iowa laws and new state laws around the country, discuss conflicts of law and contemplate other compliance issues. This program will cut through the political rhetoric to identify these post-Dobbs issues now facing providers.

3:00 – 3:45 p.m. | Addressing Poor Patient Outcomes and Medical Mistakes – Discussion of Common Questions

It is an unfortunate reality that poor patient outcomes and medical mistakes occur.  While thankfully these events are not an everyday occurrence, they bring many considerations, including various compliance and legal matters.  Given the relative rarity, it is easy to feel like not all the bases are covered.  This session will involve a discussion moderated by John Holdenried.  Barbara Person and Kim Lammers will cover the most common legal and compliance questions and concerns we hear from clients following a poor patient outcome or medical mistake. Expect to feel better prepared to face these difficult circumstances.
