New Form I-9 Required Starting November 1st

on Wednesday, 1 November 2023 in Labor & Employment Law Update: Sarah M. Huyck, Editor

Beginning November 1, 2023, all employers must use the revised Form I-9 (08/01/2023 edition) that was released this year.  The new streamlined and shortened Form I-9 was effective August 1, 2023, but employers were permitted to use both the former (10/21/2019 edition) and new (08/01/2023 edition) Forms I-9 up through October 31, 2023.

Now, employers should stop using any prior Forms I-9 by November 1, 2023 and switch to the new form, for both new hires and reverifications.  Employers who fail to do so may be subject to fines.

For more information about the new changes to the Form I-9, read Baird Holm’s update here.

As a reminder, eligible E-Verify employers may also remotely examine employee identity and employment authorization documents using a new remote procedure.  Read more about this remote eligibility verification process in Baird Holm’s update here.
