Description:
In today’s economy, organizations are exploring strategies to help them adapt, remain competitive, and best position themselves for the future. These strategies often include workforce adjustments, like reorganizations or reductions in force (RIF). Scott and Sapphire will highlight the process for these strategic decisions, and explain an employer’s obligations. This webinar will provide the key legal considerations as part of an employer’s workforce adjustment process, including adverse impact analysis, Worker Adjustment and Retraining Notification Act (WARN), state mini-WARN obligations, and severance and release program options.

This webinar will help participants:

    •  Understand key legal considerations for RIFs and strategic reorganizations, including adverse impact analysis, compliance with the Older Worker Benefit Protection Act, analysis of job actions under the Worker Adjustment and Retraining Notification Act (WARN) including attributing remote workers, state release requirements, discrimination laws, and other relevant regulations to minimize legal risks during a RIF
    • Learn best practices to creating a strategic approach to RIFs, including developing and documenting selection criteria, communication strategies, severance considerations, retention arrangements, and outplacement
    • Recognize communications, forms, documents, and notices that may be required as part of a RIF process
