EEOC Delays 2021 EEO-1 Filing

The EEOC recently announced that the 2021 EEO-1 Component 1 Data Collection period will tentatively open on April 12, 2022, with a tentative deadline to file by May 17, 2022.  This differs from the traditional timeline, which required covered employers to file the EEO-1 by March 31st.  The fact that these dates are already labeled as “tentative” reflects the likelihood that they will change as we get closer to April.   We will keep you posted!

Additionally, thus far, it appears that employers will only be required to submit the Component 1 Report (i.e., the basic demographic data that the EEOC has traditionally collected), as opposed to also provide summary compensation data in a “Component 2” report. 

We will continue to monitor for developments.  In the meantime, employers should begin gathering their 2021 demographic data to ensure timely compliance with their filing obligations.
