EEOC Updates “Know Your Rights” Poster

Out with the old, in with the new… For a required workplace poster, that is!  On October 19, 2022, the U.S. Equal Employment Opportunity Commission (“EEOC”) released a new “Know Your Rights” poster.  The poster, prepared by the EEOC, summarizes federal laws prohibiting job discrimination and identifies the reporting process for employees and applicants who wish to file discrimination complaints.  This new “Know Your Rights” poster replaces the previous “EEO is the Law” poster.

As a reminder, covered employers should prominently display these “Know Your Rights” posters at the worksite.  Generally, this notice should be physically posted in a “conspicuous location in the workplace where notices to applicants and employees are customarily posted” like a bulletin board or employee breakroom.  As a supplement, covered employers are also encouraged to digitally post the notice on their web sites.  Noncomplying employers may be subject to fines.

The new “Know Your Rights” poster is currently available in English and Spanish on the EEOC web site, with more translations expected to be released.
