Nebraska Department of Labor Releases Model Paid Sick Leave Notices

Pursuant to the Nebraska Healthy Families and Workplaces Act (“NHFWA” or “the Act”), the Nebraska Department of Labor (“NDOL”) has released model notices and posters.  These model documents may be used to satisfy the statutory requirement that employers provide notice to employees of their rights under the Act. 

As a reminder, employers must provide written notice of the NHFWA to employees by September 15, 2025.  After that, employers must continue to provide written notice to employees when employment begins. In addition to the written notice component, employers must also display a poster in the workplace which contains the information provided in the notice. 

Notices provided via electronic communication and posters presented via a conspicuous posting on a web-based platform are acceptable for employers that do not have a physical workplace. The NDOL’s model poster and notice outlines the effective date of the Act, accrual amounts, acceptable uses of sick time, and other rights under the NHFWA. Additional information about the NHFWA can be found in prior Baird Holm alerts summarizing the original ballot initiative and the subsequent legislative bill. Employers should work to create or update policies to comply with the NHFWA, which takes effect on October 1, 2025.
