Reminder: Compliance Deadlines Approaching for Nebraska’s New Paid Sick Time Law
Nebraska’s Healthy Families and Workplaces Act (“NHFWA”) will officially take effect on October 1, 2025, bringing new paid sick time obligations for many private employers across the state.
As a reminder, covered employers must provide written notice of employee rights under the NHFWA to employees by September 15, 2025. After that, employers must continue to provide written notice to new employees when employment begins. In addition to the written notice component, employers must also display a poster in the workplace which contains the information provided in the notice. Note, these written notice and poster obligations apply even if the employer’s current paid time off policies already meet or exceed the NHFWA time off requirements.
The Nebraska Department of Labor (“NDOL”) has released model notices and posters that may be used to satisfy the statutory notice requirements under the NHFWA. Notices provided via electronic communication and posters presented via a conspicuous posting on a web-based platform are acceptable for employers that do not have a physical workplace. Many Nebraska employers have chosen to review and update their time off policies (like PTO) or create new sick time policies altogether. With the deadline approaching, employers should ensure policies are compliant with the NHFWA and be prepared to send employee communications to meet required notice obligations.
