Time Well Spent: 2026 Wage and Hour Update
In 2026, the U.S. Department of Labor issued thirteen opinion letters so far that provide valuable insight into the agency’s current enforcement and compliance priorities. Join Scott, Allie, and Sapphire as they break down important DOL opinion letter updates, including guidance on employees performing additional work, percentage-of-total-earnings bonuses, meal periods and off-site travel, pre-shift work and rounding practices, travel time for hybrid and remote employees, and tip-pooling restrictions for supervisors. This session will highlight the most helpful of these new DOL opinion letters and their legal significance, both as a defense and compliance tool, and also cover key legislative and regulatory developments affecting exemption salary thresholds, overtime obligations, and tip-related payroll requirements under the One Big Beautiful Bill.

Scott S. Moore is one of the few employment lawyers regionally who has been selected as a Fellow of The College of Labor and Employment Lawyers (the premier peer-selected organization of labor and employment lawyers in North America), and as a member of the American Employment Law Council (the Nation’s premier organization for management-side employment lawyers).
Allison D. Balus
Allison D. Balus primarily represents management clients in federal and state court employment-related litigation and arbitration. Her litigation experience includes federal court jury and bench trials in the FLSA, ADA, Title VII, FMLA, ADEA, breach of contract, and whistleblower cases. She has represented employers in the retail, food processing, health care, manufacturing, marketing, professional staffing, transportation, and fast-food industries, among others.
Sapphire M. Andersen
Sapphire M. Andersen is a member of the firm’s Labor, Employment and Employee Benefits Group. She assists employers in all aspects of labor and employment law compliance, including preparing and reviewing personnel policies, advising on equal employment opportunity, and defending claims of discrimination, harassment, and retaliation filed with local, state, and federal agencies. Sapphire advises clients on general day-to-day employment issues, including those related to the FLSA, FMLA, and other federal and state regulations.
