Ben Busboom specializes in environmental and energy matters. Ben’s legal and technical tenure within the environmental and energy industries enables him to provide a level of service unique to both Nebraska and the Midwest. Prior to moving back to his home state of Nebraska and joining Baird Holm, Ben worked for a Fortune 500 energy company, an international engineering firm, and an AmLaw 200 law firm’s national energy and environmental practice group. Ben’s individual legal work in the fields of Energy and Natural Resource Law has been repeatedly recognized by Super Lawyers who named him a Great Plains Rising Star in 2018 and 2019 and a Missouri & Kansas Rising Star in 2017.

Ben regularly provides counsel on matters pertaining to: permitting and compliance; oil and gas; renewable energy; environmental risks and liabilities; pipeline easements and siting; natural resource use and acquisition; land use; and dispute resolution (both administrative and civil).

In addition to his Juris Doctorate, Ben holds three Graduate Certificates from the Washburn University School of Law in the fields of: Oil and Gas Law; Natural Resource Law; and Business and Transactional Law (earned with distinction) and Ben currently serves as the Chair of the Natural Resources and Environmental Law Section of the Nebraska State Bar Association and as Nebraska’s trustee to the Rocky Mountain Mineral Law Foundation (an international non-profit organization dedicated to the scholarly and practical study of the laws and regulations relating to oil and gas, mining, energy, public lands, water, environmental, and international law). Ben is also a frequent speaker and subject matter expert on topics relating to environmental law, energy law, oil and gas law, mineral law, and natural resource law.

  • Obtaining, reviewing, and providing advice on Phase I and Phase II Environmental Site Assessments for a variety of clients across a variety of business sectors
  • Facilitating both asset and stock transfers of waste, energy, and construction companies
  • Guiding both developer clients and investor clients through the permitting and diligence process associated with windfarm construction
  • Mitigating environmental penalties for accidents stemming from: pipeline ruptures, permit violations, regulatory shortcomings, and spills
  • Conducting internal audits of clients' risk and response programs and providing client training on new or changing regulatory requirements 
  • Providing advice on issues stemming from state and federal environmental regulations such as: CERCLA, RCRA, CWA, EPCRA, CAA, FIFRA, and ESA 
  • Facilitating permit acquisition associated with large scale pipeline rights of way 
  • Acquisition and maintenance of industrial and agricultural water rights
  • Drafting and revision of oil and gas leases and resolution of oil and gas disputes
  • Permitting and acquisition of injection wells
  • Classification of special types of wastes and/or waste exemptions
  • Reviewing and structuring multi-phase tax driven solar projects
